No murder charge in case of baby cut from womb

A former nurse’s aide will not face murder charges for allegedly cutting and removing an unborn baby from the mother’s womb, Boulder County, Colorado, prosecutor Stanley Garnett said Thursday.

The mother, Michelle Wilkins, answered a Craigslist ad for baby clothes on March 18. When she arrived at the purported seller’s home in Longmont, she was attacked, beaten, cut open and her fetus was removed. The baby did not survive. Wilkins was treated at a hospital and later released.

The alleged attacker, Dynel Lane, 34, is being held on a $2 million bond.

Viable life

After the attack, prosecutors said it may be hard to muster a murder charge. Colorado state law does not recognize a fetus as a person, unless it is capable of surviving for a period of time outside the womb, a prosecutor said then. But the extent of the period that the fetus must survive in order to be defined as a baby is not legally clear.

Lane’s husband, David Ridley, told police he found the baby on the day of the attack in a bathtub taking a breath.

Lawmaker calls attack “act of God”

Meanwhile, a Republican lawmaker from Colorado is facing rising outrage after he refused to apologize for comments on his evangelical YouTube program attributing the death of an unborn child cut out of a pregnant woman’s stomach to an act of God.

School employee accused of barricading students in classroom

Employee at San Diego County school arrested on 28 counts of endangering, imprisoning children

A 31-year-old employee of the Lemon Grove School District was arrested on suspicion of refusing to let students leave their classroom, then barricading herself in the room and taking off her clothes, according to the San Diego County Sheriff’s Department.

Linda Lira, an after-school assistant at the Lemon Grove Academy, a school for students from kindergarten through sixth grade, was arrested and booked into jail on 14 counts of child endangerment and 14 counts of false imprisonment.

The incident at the school in the suburb east of San Diego began Wednesday with Lira “acting bizarre” and barricading herself and the children in a classroom, according to Sheriff’s Lt. Chris May.
Students became frightened and used a campus radio to call for help. Staff members “fought with Lira to gain access to the classroom and remove children from her reach,” the Sheriff’s Department said.

Lira was showing “multiple signs and symptoms of narcotics/hallucinogen use,” including throwing things and “undressing and redressing several times,” the Sheriff’s Department said.

After sheriff’s deputies arrived, Lira was taken to a hospital for evaluation, then booked into Las Colinas women’s jail.

Deputies spent Thursday interviewing students. Social workers and therapists were at the school to provide counseling.

Lira is being held without bail pending arraignment set for Monday, according to jail records.
